DIGITAL SERVICES PRIVACY POLICY

Most importantly, we never sell your personal information to anyone!

This Privacy Policy applies to your access and use of all Noble Roman’s Pizza, Noble Roman’s Craft Pizza & Pub, Best Pizza Program, NROM and other Noble Roman’s (summarized hereafter as “Noble Roman’s”) related websites, mobile applications, and other digital programs and services (“Digital Services”). By accessing or using any of the Digital Services, you agree that you have read and agree to be bound by this Privacy Policy. If you do not agree, please do not use any of the Digital Services.

The policy will be updated and changed from time to time, so check here periodically for any changes. If you do not agree to the new terms, you should stop using the Digital Services. The new terms will take effect on the date the updated Privacy Policy is posted.

IN GENERAL

When you use any Noble Roman’s Digital Services, we may collect information about you and we may share information with third parties in certain circumstances that facilitate the use, monitoring and management of our Digital Services. We will always do this in accordance with the law and this Privacy Policy, which we have formulated to give you more information about such collection, use and sharing.

Our businesses are located in the United States of America, but we use some third party services in Canada as well. By using any of the Digital Services, you understand and agree that any information you submit or that is gathered about you will be transmitted and stored within the United States and/or Canada. You further consent to the use and disclosure of that information in accordance with applicable U.S. Federal and State laws, Canadian Federal and Provincial laws, and with this Privacy Policy.

INFORMATION WE COLLECT

Noble Roman’s will treat any information that can be used to identify you as an individual as “Personal Information.”  The types of information we collect that identify you or relate to you as an individual may include things such as the following:

  1. Name, date of birth, mailing address, telephone number, e-mail address, username and password (for account administration), etc. which would only be supplied to Noble Roman’s by you voluntarily.

  2. Device ID, including IP address, which are automatically collected and, while they don’t identify you as an individual, do identify a particular computer or mobile device.

  3. Geolocation, especially for identifying Noble Roman’s business locations relative to your own location.

  4. Financial account information and other payment information that you submit to us voluntarily to enable order and/or service processing.

  5. Additional Personal Information you may submit as necessary for the administration of particular promotional events, news updates, email clubs, etc.

Other types of non-personal information will also be collected periodically when you use the Digital Services, such as:

  1. Type of browser and operating system, mobile application usage data, and aggregated information such as website entry and exit points (including referring URLs or domains), traffic statistics, page views, and impressions, all of which are collected automatically.

  2. Consumer information you choose to submit to Noble Roman’s voluntarily and which we may combine on an anonymous basis with similar information from other users to enable us to better understand and facilitate the use of Digital Services.

  3. Information collected through cookies, web beacons, pixel tags and other technologies (see more on these topics below).

  4. Device Information, such as device type, operating system, etc.

HOW WE USE INFORMATION

We may use Personal Information about you for purposes described in this Privacy Policy or as otherwise disclosed to you through the Digital Services. This includes the following:

1.      Process and manage your account and your purchase and use of our products and services and information requests.

2.      Respond to your inquiries or requests, and to post your comments or statements on message boards or in our Digital forums.

3.      Create and deliver personalized promotions or information based on your purchases and other interactions with us.

4.      Send you communications about offerings and programs from Noble Roman’s.

5.      Improve our Digital services, including to perform data analysis, audits, fraud monitoring and prevention, identify usage trends, determine the effectiveness of our promotional campaigns, and to promote the furtherance of our business activities.

USE OR SHARING OF PERSONAL INFORMATION

We never sell your Personal Information! Except as set forth below, we will not knowingly disclose your Personal Information to anyone outside of Noble Roman’s or our third-party service providers who provide functionality to our Digital Services (collectively “Noble Roman’s”):

·         To Perform Services For You
We may disclose your Personal Information to third-party service providers to provide us with services such as online ordering, digital app development and management, payment processing, website hosting, professional services, including information technology services and related infrastructure, customer service, e-mail delivery, auditing and other similar services necessary to the Digital Services and your usage thereof.

·         Corporate Transactions or Events
We may disclose your information to a third party in connection with a corporate reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock, including in connection with any bankruptcy or similar proceedings.

·         Compliance with Law
We may use or disclose your Personal Information as we deem necessary or appropriate: (1) under any applicable laws with which Noble Roman’s must comply; (2) to respond to enforceable requests from public and government authorities; (3) to comply with subpoenas and other legal processes; (4) to pursue available remedies or limit damages we may sustain; (5) to protect our operations or those of any of our affiliated companies; (6) to protect the rights, privacy, safety or property of Noble Roman’s or others; and (7) to enforce our terms and conditions.

COOKIES

Noble Roman’s and its third-party service providers and agents often use small text files called Cookies that are placed in your computer’s browser to store your preferences. This is standard practice in website and e-commerce management. Cookies are not themselves personally identifiable, but under certain circumstances they may be capable of identifying you as a person.  The information collected by these tools is generally Non-Personal information but could potentially be used in connection with other data to uniquely identify you as a user to enhance your experience while using the Digital Services. Web browsers allow some (or even extensive) control of most Cookies through the browser settings. However, it is important to know that if you disable Cookies, features of the Digital Services may not work as well (or at all) for you.

DIGITAL ADVERTISING
We use Cookies and other technologies, such as pixel tags, web beacons, and clear GIF files, to help manage our digital advertising program. These technologies may enable us (or third-party advertising services we work with) to learn which advertisements bring users to the Digital Services. They may also enable us (or third-party advertising services we work with) to track the actions of Digital Services users over time and across different web sites or platforms to measure statistics of our marketing efforts, and to deliver electronic advertisements that may be more relevant to individual consumers and that will improve your user experience.

ANALYTICS
We use third-party services such as Google Analytics to gather and analyze anonymous Digital Services user information. [Google Analytics is a web analytics service provided by Google, Inc. ("Google"), to collect information about use of the Digital Services. Google may use Cookies to collect information about your purchase history, the content you view, what websites you visit immediately prior to and after visiting the Digital Services, and your system information and geographic information. The information generated by the Google Cookies about your use of the Digital Services will be transmitted to and stored by Google. The information collected by Google allows us to analyze the use of the Digital Services, but does not identify you. Google will have their own Privacy Policy over which Noble Roman’s has no control.]

SOCIAL NETWORKING AND THIRD-PARTY SITES

Noble Roman’s does not control, and is not responsible for, the privacy practices and policies of such social networks and services, or of the third-party service providers and agents utilized in Digital Services. You should separately consult the privacy policy of such social networks and services. If you post information in a public forum, it becomes public information and may be used as such. The Digital Services may provide links to and from other sites or services. If you use such other sites or services, separately consult their privacy policies. Noble Roman’s is not responsible for the privacy practices of any other site or service.

CHILDREN UNDER 13

Noble Roman’s Digital Services are designed to invite a general audience seeking our products and services or to learn about our company and what we have to offer, and we do not knowingly collect information from children or sell products or services directly to children, especially those under the age of 13. Additionally, parents are asked to supervise their children’s online activity and consider parental controls where and when necessary.  If you are under the age of 13, you should not use our Digital Services unless you have asked for and received parental or guardian permission and advice in using our Digital Services.  If we have inadvertently collected Personal Information from someone under the age of 13, we will be happy to discard such information upon specific request.

SECURITY

We strive to use reasonable safeguards (most commonly within third-party service providers, over which we have no control) to help prevent loss, misuse and unauthorized access, disclosure or modification of Personal Information provided or collected through the Digital Services by employing appropriate and reasonable measures. However, no system is perfect, and we cannot guarantee that unauthorized access or theft will not occur.

MANAGING YOUR ACCOUNT AND COMMUNICATION PREFERENCES

To update or correct your account information – or if you would like to stop receiving marketing communications from us via email or other methods – you may contact us as provided for in the Digital Services or at digitalservices@nobleromans.com.

WE ARE NOT PERFECT!

We always strive to ensure that the information contained within our Digital Services is accurate and reliable and that the Digital Services function as intended. However, Noble Roman’s, its franchisees, third-party service providers, suppliers, manufacturers, and other partners, agents and vendors are not infallible, and errors and system failures may sometimes occur. Therefore, to the fullest extent permissible pursuant to applicable law, Noble Roman’s disclaims any warranty of any kind, whether express or implied, as to any matter whatsoever relating to our Digital Services, including without limitation the factuality, precision, fitness, operability and functionality for any particular purpose. Noble Roman’s will not be liable for any indirect, special, incidental, or consequential damages arising out of any use of the Digital Services or the information contained herein.
